Commissioners to appear today for legal hearing

A hearing on a preliminary injunction in Maries County Circuit Court, Judge John Beger presiding, is scheduled today, Wednesday morning, May 13.

Members of the Maries County Commission planned to be there and are likely witnesses in the proceedings that will take place very carefully in the courtroom because of the COVID-19 coronavirus. The commissioners made no further comment about it at last week’s commission meeting.

The county commission is represented in this legal matter by Maries County Prosecuting Attorney Anthony “Tony” Skouby.

The hearing is for the lawsuit filed by Ronald and Anne Calzone, who sued the county commission for alleged violations of the Missouri Sunshine Law.

Both parties requested an in-person hearing.

Judge Beger found the hearing on a preliminary injunction is an exception to the Missouri Supreme Court’s COVID-19 order prohibiting in-person court and this hearing will be conducted in person with specific provisions.

The sheriff, bailiff or other court security personal will limit those in the courtroom to 20, including the judge, clerk, court reporter, parties, counsel and witnesses.

All in the courtroom will, to the extent possible, observe appropriate social distancing guidelines, staying at least six feet apart, no handshaking or touching. Masks and gloves are not required but will be allowed.

The bailiff will have information available at the courtroom door for spectators to listen/observe the hearing by Webex.
