White, attorneys fail to appear in Maries County court — City’s Sunshine Law litigation to be heard Thursday via Webex

BELLE — Daryl White, Jr., a former Belle mayor charged on allegations of misdemeanor stealing and official misconduct, was scheduled to be in Maries County’s 25th Circuit Court on May 6, for a pretrial conference. However, White, his attorney, and the Missouri Attorney General’s Office special prosecutor all failed to appear.

“State versus Daryl White, Jr.,” Judge William E. Hickle called the case on Monday morning, but no one was present from either side to answer.

Maries County Prosecuting Attorney Tony Skouby, who recused himself from the case in March, told Hickle he was no longer involved and wasn’t sure where the parties were.

“Did we not set it for trial?” Hickle asked as he reviewed the documents. “We need to know what’s going on.”

Hickle noted that the case was set for trial on June 10-12 in Phelps County, Rolla.

“We need to know what they want to do,” Hickle said.

Skouby said he received word from the Maries County Sheriff’s Office on Friday that lab work was back regarding the case, but wasn’t privy to the results.

“The AG just got the lab results back and none has been provided to us yet,” Skouby said.

The lab work was forwarded to the Attorney General’s Office.

“Figure out what’s going on and put it on recall,” Hickle said.

An email inquiry on Monday afternoon to the Attorney General’s communications director was not answered by The Advocate’s deadline.

Skouby said he would contact the Attorney General’s Office following court. Tuesday morning, Skouby said Hickle spoke with White’s attorney, Thomas John Kirsch. He wasn’t sure if the Attorney General’s Office had been in contact.

“A full pretrial conference did not happen,” Skouby said. “T.J. Kirsch and the judge did have a conversation and they are going to have to continue that by another Webex in the future. They held a pretrial conference, but may have to hold another in the future.”

According to Missouri Case.net, a pretrial conference was held , the defendant did not appear, and a Webex will be held in the future. The final edict from Hickle was, “The case stays in Maries County for now.”

When asked about the future location of the case, Skouby explained, “They are wanting to keep it here until they have to ship it over there.”

The case will be moved to Phelps County for the trial after the pretrial conference is held.

State versus the city of Belle, a case regarding alleged violations of Missouri Sunshine Law, will be heard at 9 a.m. on Thursday, May 9, via Webex in Hickle’s Phelps County courtroom.
